Xprompt Terms of Service
1. Scope
These Terms apply when you access or use Xprompt websites, apps, APIs, prompt management, model runs, debugging records, public sharing, published API versions, wallet balance, membership, and related services.
Xprompt is offered globally. We may restrict certain regions, accounts, or features when required by law, platform rules, sanctions, export controls, third-party service availability, or technical safety.
Paid services are also governed by the Commercial Terms. Personal information is handled under the Privacy Policy. Prompts, user content, and AI outputs are governed by the AI & Content Policy. Together, these documents form the rules for using Xprompt.
2. Acceptance and age
By registering, logging in, clicking a confirmation, purchasing, running a Prompt, publishing an API, or continuing to use Xprompt, you agree to these Terms and confirm that you have read the related policies.
You must be at least 12 years old. If the law where you live requires a higher age, guardian consent, or verifiable parental consent, that rule applies. If you are under the age of majority where you live, you should use Xprompt with the knowledge and consent of a parent or legal guardian.
3. Account and security
You should provide an accurate, reachable email address and protect your verification codes, login sessions, API tokens, custom model keys, and devices.
You may not share, rent, sell, or transfer your account, impersonate others, or bypass security, region, metering, or payment controls. If you believe your account is compromised, contact us through the in-product support entry.
Actions made through your account, session, or token are generally treated as your actions unless you can show that the account was compromised and you notified us promptly.
4. Services and changes
Xprompt may provide prompt creation, editing, versions, use cases, debugging, model runs, history, public sharing, Codex temporary access, published API versions, model cost tracking, wallet balance, and Xprompt Plus. Actual features depend on the product page, account status, region, plan, and what is shown at the time.
Beta, preview, free, or experimental features may be unstable and should not be used for production-critical tasks. We may change services for security, compliance, supplier changes, or product improvement. If a change materially harms a paid service, we will provide reasonable notice and any remedy required by applicable law.
5. Third-party models and services
When you run a Prompt, the request may be sent to the third-party model provider shown in the interface or selected by you. Payment, email, SMS, cloud infrastructure, support, and security services may also be provided by third parties. Their own terms and privacy policies may apply.
If you use a custom model, API key, endpoint, or third-party account, you are responsible for ensuring that you have the right to use it and for the cost, permissions, and data settings of that third-party service.
6. AI outputs and important decisions
Model outputs are generated by AI and may be inaccurate, incomplete, outdated, biased, infringing, or unsuitable for your purpose. You should review facts, sources, rights, safety, and suitability before using, publishing, executing code, or commercializing outputs.
Unless agreed in a separate written contract, you may not treat Xprompt or model outputs as a substitute for professional review in medical, legal, financial, insurance, hiring, education, housing, law-enforcement, immigration, or other high-impact decisions.
7. User content
You retain the rights you have in your Prompts, inputs, files, use cases, configurations, and other user content. You grant Xprompt a limited license to process that content only as needed to provide, maintain, protect, troubleshoot, meter, bill, comply with law, and perform the features you choose.
You must have the rights needed to submit and use the content. Do not submit unnecessary sensitive personal information, trade secrets, access keys, payment information, or regulated data.
8. Acceptable use
You may not use Xprompt to:
- violate law, sanctions, export controls, or platform rules;
- infringe intellectual property, privacy, likeness, voice, personality, confidentiality, or data protection rights;
- create or spread child sexual abuse material, non-consensual intimate content, serious violence, terrorism, hate, fraud, impersonation, unlawful discrimination, or self-harm encouragement;
- develop malware, cyberattacks, authentication bypass, credential theft, unauthorized monitoring, or large-scale spam;
- bypass Xprompt or model-provider safety, metering, region, quota, payment, rate, or content controls;
- scrape, resell, copy, or bulk-provide the platform to third parties through account sharing;
- remove, tamper with, or falsify legally required AI content labels.
More detailed content rules are in the AI & Content Policy.
9. Monitoring, restrictions, and appeals
Where allowed by law and when necessary, we may use automated or human review to handle security incidents, abuse, payment fraud, illegal content, infringement notices, or platform risks. We may warn, refuse generation, revoke sharing, restrict models or APIs, freeze balance or accounts, suspend, or terminate services.
If an action materially affects you, we will explain the general reason and appeal channel unless law, safety, or an emergency prevents notice. You may appeal through the in-product support entry.
10. Paid services
Wallet top-ups, balance, model billing, Xprompt Plus, published API versions, orders, refunds, taxes, and transaction disputes are governed by the Commercial Terms.
Xprompt Plus currently requires manual purchase or renewal. Xprompt does not currently auto-renew Plus or automatically charge your wallet for the next period. If auto-renewal is introduced later, we will clearly disclose cycle, amount, billing frequency, cancellation, refunds, and contact information before purchase and obtain any legally required consent.
11. Termination and data handling
You may stop using Xprompt and request account deletion through the product. Before deletion, export content you need, revoke public shares, and handle unfinished orders.
We may suspend or terminate access if you materially breach the rules, create safety or legal risk, fail to pay, initiate fraudulent or disputed payments, or if we must do so by law or platform requirement.
After termination, we may delete or restrict data according to the Privacy Policy, backup cycles, legal obligations, tax and accounting rules, security, and dispute needs.
12. Disclaimers
Xprompt is provided on an “as is” and “as available” basis to the extent allowed by law. We do not guarantee uninterrupted service, error-free output, fitness for a particular purpose, or that AI outputs are unique, non-infringing, or legally protectable.
Nothing in these Terms limits rights that cannot be waived under applicable consumer or data protection law.
13. Liability
To the maximum extent allowed by law, Xprompt is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or damages caused by third-party models, payment providers, networks, or user content.
Where liability cannot be excluded, it is limited to the greater of the amount you paid to Xprompt for the affected service during the 3 months before the event or the minimum amount required by applicable law.
14. Changes to these Terms
We may update these Terms as the product, law, or risk changes. Material changes will be notified through the product, account, email, or an equivalent method before they take effect where required. Continuing to use Xprompt after the effective date means you accept the updated Terms.
15. Contact
Questions, support requests, appeals, infringement notices, and privacy requests can be submitted through the in-product support entry.
